ORDINANCE NO. 10539 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE TRACT(S) OF LAND LOCATED IN THE 1800 BLOCK OF GUNBARREL ROAD, AND THE 7400 BLOCK OF IGOU GAP ROAD, BEING ON THE SOUTHEAST LINE OF GUNBARREL ROAD AT IGOU GAP ROAD, FROM R-1 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: Two tracts of land located in the 1800 block of Gunbarrel Road, and the 7400 block of Igou Gap Road, being on the southeast line of Gunbarrel Road at Igou Gap Road. Lots 1, 2, and 3, James Frist Subdivision, as shown by plat of record in plat book 41, page 233, ROHC, and part of tract 3, Citizens Bank and Trust Company Subdivision, as shown by plat of record in plat book 4, page 48, ROHC; being the properties described in deed book 2452, page 567, ROHC, deed book 2452, page 565, ROHC, deed book 2452, page 569, ROHC, deed book 3191, page 576, ROHC, deed book 1532, page 321, ROHC, deed book 3772, page 252, ROHC. Tax Map No. 159A-A-1.1, 1.2, 1.3, 1.4, 1.5, 2, 2.1, 3, 5, and 6. from R-1 Residential Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Growth Corridor Standards relative to landscaping, screening, buffer areas, (together with the additional landscaping standards, attached hereto) sidewalks, etc. Specific street improvements, access requirements, and right-of-way dedication requirements of the Growth Corridor Policy will be replaced by alternate requirements by the City Engineer and City Traffic Engineer. 2. The outparcels, including the parcel on the corner of Gunbarrel and Igou Gap Roads, shall have no driveways to or from Gunbarrel Road. 3. There shall be only one driveway, serving as ingress and egress, for the Igou Gap Road parcel. 4. Dedication of an additional 12 feet of right-of-way along Gunbarrel Road frontage. 5. Construction of a 12 foot acceleration/deceleration lane along the entire Gunbarrel Road frontage and rebuild the 5 foot wide sidewalk. 0C 6. There shall be only two driveways permitted to the shopping center into or from Gunbarrel Road. 7. Dedication of additional right-of-way along the Igou Gap Road frontage to have 40 feet from centerline. 8. Construction of a 32 foot roadway as measured from the centerline along the entire south frontage of Igou Gap Road plus a 5 foot wide sidewalk. 9. Construction of 150 feet long 3 lane roadway and 150 feet long taper from 3 lanes to 2 lanes, beginning at the east property line of the center and extending 300 feet east of the east property line within the existing right-of-way of Igou Gap Road. 10. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
